They invited him to speak at hearings. They appeared to listen to his testimony. Then they blundered on as if he wasn't there.<br /><br />Instead of looking like an intelligent body of legislators, Congress looked like an out of control oil tanker on a collision course with the docks.<br /><br />The very legislators that I have voted for in the past helped set this ill fated tanker on it's course. Altho...Rick,thank you for everything you have done. Although I am part of one of the 'saved' groups (resale) this 'relief' comes far too late to help me. After coming perilously close to bankruptcy, I managed to get out of my lease and close down my resale operations with a shred of money and a mountain of debt. So the only relief I will now enjoy is knowing I don't have the burdens of being a business owner since I have had to rejoin the ranks of the employed to begin the long paydown of my debt. The CPSC and their fearmonging friends successfully scared off many of my former resale customers. You fail to note that this arrangement is very similar to the original Republican-authored ECADA bill. In particular, it stipulates that: "If the Commission determines that no alternative testing requirement is available or economically practicable, it shall exempt small batch manufacturers from third party testing requirements". So, yes, the Commission has the ability to determine alternative tests which assure conformity with a given product safety standard, but those tests must be economically feasible for small businesses or an exemption will apply. This is a clear difference from Waxman's 2010 bill. Here, we have a clear congressional mandate to provide meaningful relief to small batch manufacturers. <br /><br />Yes, it could be argued that the current Democratic majority of CPSC commissioners might brazenly ignore congress and define "economically feasible" and "assure" in such a way so as to provide little real relief. We don't believe that will be the case, but we do recognize that our fight is far from over. Besides, each commissioner has a finite term, as does the President. It is therefore unlikely that the current commission's inflexible stance will continue indefinitely.
